Terms and Conditions for Capistrano Property Vacation Home Rental

Please read these Terms and Conditions (“Terms”) carefully before using the www.6706Capistrano.com website (the “Service”) operated by Capistrano Property (“us,” “we,” or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Reservations and Booking
1. **Reservation Confirmation**: A reservation is considered confirmed only upon receipt of payment and a confirmation email from Capistrano Property.
2. **Payment Policy**: Full payment is required at the time of arrival. We accept payments by:
A. Zelle
B. Check
C. Direct Deposit
D. Credit Card
3. **Cancellation Policy**: Cancellations made 5 or more prior to the scheduled arrival date will receive a full refund. Cancellations made within 5 of the scheduled arrival date are subject to a 50% cancellation fee.
Check-In/Check-Out
1. **Check-In**: Check-in time is 03:00 pm. Early check-ins may be accommodated based on availability.
2. **Check-Out**: Check-out time is 10:00 am. Late check-outs may be accommodated based on availability and are subject to an additional fee.
Property Usage
1. **Occupancy Limits**: The maximum occupancy for the property is 6. Overcrowding will result in cancellation without refund.
2. **Use of Property**: The rental property is to be used for residential purposes only. Parties and events are not allowed without prior written consent.
Property Care and Conduct
1. **Property Care**: Guests are responsible for maintaining the property in good condition and agree to leave the property in the same condition as it was upon arrival.
2. **Conduct**: Guests agree to behave responsibly, treating the property, neighbors, and surrounding areas with respect. Any disruptive behavior may result in eviction without refund.
Liability and Damages
1. **Liability**: We are not responsible for any accidents, injuries, or illnesses that occur while on the premises. We are not responsible for the loss of personal belongings or valuables.
2. **Damages**: Guests are responsible for any damages to the property caused by them during their stay.
Governing Law
These Terms are governed by and construed in accordance with the laws of California, without regard to its conflict of law provisions.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least [number of days] notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
